Het oordeel van de IACCM over het handelen van de gemeente Alphen aan den Rijn bij het hijsongeval met de 2 kranen en de ravage na het omvallen.

Als Association for Procurement Risk Management werden Cecile van Velzen en Jeroen Corts uitgenodigd op de IACCM-bijeenkomst van 1 november een gastcollege te geven over risicobeheersing bij inkoop.

De International Association for Contract & Commercial Management, afgekort de IACCM is niet zo maar een club. Het is een uitgebreid internationaal netwerk met meer dan 40.000 leden, waarvan het merendeel bestaat uit grote, internationaal opererende concerns met vele vertakkingen in diverse landen. De IACCM organiseert indringende activiteiten in meer dan 160 landen en omspant ongeveer 16000 organisaties. Zoals de naam aangeeft bestudeert de IACCM contracten, contractvormen en commerciële handelsrelaties in de meest brede zin. De presentatie van Cecile en Jeroen viel zeer goed bij het selecte gezelschap dat op 1 november 2016 bijeen was bij NetApp, Schiphol Rijk.

Aan de aanwezigen werd ook een case voorgelegd met 4 vragen die betrekking hadden op de verantwoordelijkheid en de eventuele aansprakelijkheid van de gemeente. De IACMM maakte korte metten met haar opvattingen over de gemeente.

  1. Do you think there is a shared responsibility with the hoisting company in relation to the unwanted incident? In other wordings: is the municipality a shared risk owner or not?

  1. Assume that no insurance was taken out covering responsibilities and liabilities. Is the municipality legally liable for the suffering and grieves of its citizens and shopkeepers?

Conclusion:

 The IACCM is very clear in its opinion about negligence, responsibility and legal liability of the municipality of Alphen aan den Rijn. The figures are convincing.
